The Democrats will not give up until they gain access to President Trump’s tax returns.
New York Democrats launched a new effort Monday to gain access to President Trump’s state tax returns. Under New York tax law, it is illegal to share someone’s state tax return information, but that is not stopping the Democrats, if they can’t beat the law, they will change it.
State Sen. Brad Hoylman introduced S5072, that would amend the state law to permit the N.Y. Department of Taxation and Finance commissioner to release any state tax return requested by the leaders of the House Ways and Means Committee, the Senate Finance Committee or the Joint Committee on Taxation for any “specific and legitimate legislative purpose.” The bill seeks to amend state laws which generally prohibit the release of such tax information.
Ed Cox, chairman of the New York State Republican Party spoke to Fox & Friends Tuesday, ripping the “partisan” move.
“It is outrageous,” he told host Ainsley Earhardt. “Because everyone has a right to keep their tax returns private under federal law and under state law, and here they are changing the law, legislation got passed, [Gov. Andrew] Cuomo says he’s going to sign it just for the President of the United States to force him to expose his tax returns, while they’re under audit.
“Look, there are a lot of agents looking at his tax returns – ‘you can take this deduction, you can’t take that deduction’ – but the American people during the campaign, he made it clear ‘I’m not going to release my tax returns’ – and guess what? They elected him President of the United States.”
Cox accused the Democrats of mounting nothing but a fishing expedition to try and find something on Trump, reiterating that it was nothing more than a “bill of attainder,” an unconstitutional legislative act that singles out an individual for punishment without trial, Fox News reported.
“This is a bill of attainder aimed at one person,” Cox said. “A bill of attainder is an ancient thing where the king doesn’t want a person to go to trial, he just wants to execute them. You have no privileges under law. You are executed. That is abhorrent under America. The Constitution forbids states from doing that, and this is a bill of attainder.”
To date, the Democrats have not given a viable reason for wanting to see President Trump’s tax returns, they have no legal cause of action. The president is not under any investigation that would require Congress to review his taxes.
From NBC News:
Democratic state Sen. Brad Hoylman, who is sponsoring the legislation, told NBC News on Monday that he believes it is “imperative” for the New York Legislature to assist Congress with the issue of Trump’s tax filings.
“Donald Trump has broken 40 years of political tradition by not releasing his returns,” Hoylman said. “His representatives say they will block all congressional efforts to obtain those returns through existing procedures. Well, it turns out that New York state has those returns and can do its part to assist the Congress in their oversight responsibility by releasing them to a relevant committee that requests them.”
According to Hoylman, Trump broke “political tradition” which is not against the law. They cannot take congressional action based on Trump not voluntarily handing over his taxes just because previous presidents chose to.
Though the bill would only apply to the president’s state returns and not the federal ones currently at the center of a Washington battle, tax filings from the president’s home state that additionally serves as the headquarters of his business are likely to contain much of the same information congressional lawmakers are seeking from his federal returns.
And, with the New York Legislature and the governor’s mansion being under Democratic control, there is a path to the bill’s passage, though similar measures did not take off in the state Assembly during the prior legislative session when Republicans held a majority in the state Senate.
Ed Cox, chairman of the New York Republican Party, told NBC News the legislation was simply the result of “Trump derangement syndrome.”
“No matter how they dress it up for legal purposes … and they’re trying different wordings to do it, this is aimed at one individual, the president of the United States, with the purpose of re-litigating the 2016 campaign in which the people of the United States knew that he had not released his tax returns and they still elected him president of the United States,” he said. “They want to re-litigate an issue that’s already been decided by the people of this country.”
The bill is “aimed just at” Trump and seeks to remove “rights and privileges that he has as a citizen of the state of New York to keep his tax returns here private,” Cox said.
The Democrats had high hopes that Special Council Robert Muller would prove the Trump campaign colluded with Russia, when the report stated there was no collusion, and went on to say that the Russians tried several times to infiltrate the campaign and failed, means the Democrats have to resort to another avenue of attack – the president’s taxes.
If the bill passes in the state Legislature, Cox said he believes Democratic Gov. Andrew Cuomo will sign it into law because it “conforms to his political ambitions to run for president of the United States.”
“He will be a presidential candidate, and he will sign it,” Cox said.
If the Democrats do obtain President Trump’s tax returns, which on principal alone I hope they do not, it will show that Trump was a very wealthy man who gave up a comfortable lifestyle to be subjected to three years of spying, phone taps, lies against him and his family, and a witch hunt investigation orchestrated by the Deep State, paid for by Hillary Clinton and the DNC, accusing him of being a Russian spy, colluding with Russia, being a trader to his country, and even of treason.
Under unimaginable circumstances, President Trump has managed to make America great again for all Americans, and that is why the Democrats are so desperate, they hate Trump more than they love the country and the American people.
